1. Who We Are
Nyenzo is operated by iDev Consulting (www.idev.co.tz), registered in Tanzania (BRELA No. 464629). Our platform is at nyenzo.com.
References to "Nyenzo", "we", "us" or "our" mean iDev Consulting and the Nyenzo platform. "You" means the adult who holds the account.
2. What These Terms Cover
These Terms govern your access to and use of Nyenzo, including all content, features and subscriptions. Creating an account means you accept them.
Read them alongside our Privacy Policy and Refund Policy, which form part of your agreement with us.
3. Who May Use Nyenzo
You must be at least 18 and legally able to enter a contract.
Nyenzo is bought and controlled by an adult. You represent and warrant that you hold parental responsibility or legal guardianship for every learner you add to your account, and that you accept these Terms on their behalf.
You keep your password confidential, you control the PINs you issue to your learners, and you are responsible for everything done under your account. Tell us promptly at central@nyenzo.com if you believe someone else has gained access to it.
4. What We Provide
We give you:
- An original curriculum from Year 1 to Year 13, written by us
- Daily lessons across the subjects on each learner's plan
- Weekly exams, marked by an AI system
- Progress tracking, confidence and focus reporting, and a parent dashboard
Nyenzo is a supplementary learning platform. It is not a school and it is not an examining body. It does not replace formal schooling. It does not award qualifications. We do not enter learners for external examinations.
We make no promise that Nyenzo content matches the syllabus of any national curriculum or examination board, and we do not guarantee any academic outcome, grade improvement or examination result. Marks awarded inside the platform exist to guide learning and show progress.
5. AI-Generated Content
We generate Nyenzo's curriculum, lessons and exams using artificial intelligence, and an AI system marks the exams. This is what lets us offer a full Year 1 to Year 13 curriculum across every core subject at this price.
We review content before publication and correct errors when we find them. But AI systems make mistakes, and human review does not catch everything. Some factual errors, unclear questions and marking inconsistencies will reach learners.
If you find something wrong, report it. Every learner and parent surface carries a reporting option, and reports go to our review queue. A person reviews every flagged mark and can change it. This is the main way errors get found and fixed, and we are grateful for it.
To the extent permitted by law, and subject to section 16, iDev Consulting is not liable for errors in generated content or for decisions taken in reliance on it.
6. Learner Accounts
Each learner gets their own profile, signed into with a name and a PIN that you set and can change.
Learner accounts cannot change billing details, alter subscription settings, or see your payment information. They cannot contact other learners or publish anything outside your account.
You decide what your learners can see. Ranking, Partners in Learning and the Co-op Network are all optional and you can switch them on or off at any time.
Please tell your learners not to type personal details into exam answers. Written answers are free-text fields, so a child could enter a surname, an address, a school name, a phone number or another person's details. We do not need any of that, we do not want it, and asking your child not to include it is the simplest protection there is.
7. Subscriptions and Payment
Nyenzo sells monthly subscriptions covering up to four learners depending on your plan. We bill in advance, and subscriptions renew automatically each month until you cancel.
Our payment provider, currently LemonSqueezy, acts as merchant of record for Nyenzo. LemonSqueezy is therefore the seller of record for your purchase. It processes the payment, handles applicable taxes, and appears on your bank or card statement rather than Nyenzo. Your purchase is governed by LemonSqueezy's terms of sale alongside these Terms, and as merchant of record LemonSqueezy may handle refunds and billing correspondence directly. We may change payment provider, and we will update this section when we do.
Subscribing authorises recurring charges to your chosen payment method until you cancel.
We show prices in US dollars. Taxes applicable where you live may be added at checkout by our payment provider. We may change our prices, and we will give you at least 30 days' notice by email before a change affects you. If you do not want to continue at the new price, cancel before it takes effect.
8. Free Trial
New subscriptions begin with a 7-day free trial. We charge nothing on the day you sign up, and you get full access for the whole trial.
Cancel before day 8 to avoid being billed. If you do not cancel, we take your first payment when the trial ends, and monthly thereafter.
We offer one free trial per household, and we may decline a trial where we reasonably believe one has already been used.
9. Cancelling
Cancel at any time from Subscription in your account. Cancelling stops future billing. You keep access until the end of the period you have already paid for, and new weeks stop unlocking after that.
The weeks your learners have already unlocked stay on your account. Resubscribe later and they are still there.
Your statutory right to cancel
If you are a consumer in the United Kingdom or the European Economic Area, you may withdraw from this contract within 14 days of entering into it, without giving a reason.
Nyenzo starts immediately, and you ask us to begin at once when you sign up. If you withdraw within the 14-day window, we refund what you have paid less a proportionate amount for the period you had access. If you withdraw during your free trial, nothing is owed either way, because we charged nothing.
To withdraw, email central@nyenzo.com with "Withdrawal" in the subject line, or cancel from your account. We acknowledge your request and refund within 14 days of receiving it.
This right sits alongside everything else in these Terms and is not replaced by any of it.
10. Refunds
Our Refund Policy governs refunds and forms part of these Terms. In short: a full free trial means we do not refund a billing period once it has begun, and nothing in that policy or these Terms limits your statutory rights.
11. Acceptable Use
You agree not to:
- Share your account credentials with anyone outside your household
- Reproduce, redistribute or commercially exploit Nyenzo content
- Reverse-engineer, scrape or extract platform content at scale, by any means
- Use the platform in breach of any applicable law
- Submit content that is unlawful, harmful, abusive or otherwise inappropriate
- Interfere with the platform's operation or security, or attempt to reach another account
12. Intellectual Property
All platform content, design, software and educational materials belong to iDev Consulting or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable licence to use Nyenzo content for personal, non-commercial educational purposes within your household.
Work your learners produce remains yours. You grant us only the licence we need to store it, mark it and show it back to you.
13. Your Responsibility to Us
If a third party brings a claim against us because you shared your account outside your household, extracted our content at scale, submitted unlawful content, or otherwise breached section 11, you will cover our reasonable direct losses and legal costs arising from that claim.
This applies only to claims caused by your own deliberate breach, only to the extent the law where you live permits, and never to ordinary use of the platform or to anything caused by us.
14. Suspension and Termination
Close your account at any time by contacting us.
We may suspend or terminate an account for a serious or repeated breach of section 11, for non-payment that remains unresolved after our retries, or where the law requires it. Unless the breach is serious enough to demand immediate action, we tell you first and give you a reasonable opportunity to put things right.
If we terminate for a reason that is not your fault, we refund the unused portion of the period you have paid for.
15. Availability
We aim to keep Nyenzo available at all times, but we do not guarantee uninterrupted access. We carry out maintenance and try to schedule it for the least disruption. Features change as the platform develops; we will not remove a material feature you are paying for without notice.
16. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that:
- Nyenzo is provided "as is". We do not warrant that it will be uninterrupted or error-free, or that AI-generated content will always be accurate.
- We are not liable for indirect, incidental or consequential loss, or for loss of profit, opportunity or educational outcome.
- Our total liability for any claim arising from these Terms will not exceed the amount you paid us in the 3 months before the claim arose.
These limits apply as far as the law that applies to you permits, and no further.
17. Changes to These Terms
We may update these Terms. For a material change we will email you at least 30 days before it takes effect and update the date and version at the top of this page. If you do not accept the change, cancel before it applies and we will refund any unused portion of a period you have already paid for.
Minor corrections that do not affect your rights — a typographical fix, or clarified wording that does not change meaning — take effect when published.
18. Resolving Problems
Contact us first. If something has gone wrong, write to central@nyenzo.com and tell us what happened. We reply within 2 business days and aim to resolve matters within 14 days.
Before either of us starts court proceedings, please give us 30 days from that first contact to put things right. Most disputes end here, and it costs neither of us anything.
Consumers in the European Union may also use the European Commission's online dispute resolution platform. Nothing in this section affects your statutory rights or your right to go to court.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Republic of Tanzania.
If you are a consumer, you may bring proceedings in the courts of Tanzania or in the courts of the country where you live. We will bring any proceedings against you only in the courts of the country where you live.
Nothing in these Terms limits any rights you have under the consumer law of your country. Where that law gives you rights or remedies these Terms do not, those rights apply.
20. General
Severability. If any provision proves unenforceable, the rest stays in force and that provision applies as far as it lawfully can.
No waiver. If we do not enforce a right immediately, we do not lose it.
Assignment. You may not transfer your account or these Terms. We may transfer them to a company acquiring our business, provided your rights are not reduced, and we will tell you before we do.
Events outside our control. We are not liable for failure to perform caused by events beyond our reasonable control, including internet or infrastructure failure, third-party service outage, natural disaster or governmental action. We will tell you if such an event materially affects the service.
Notices. We contact you at the email address on your account, so keep it current. You contact us at central@nyenzo.com.
Entire agreement. These Terms, with the Privacy Policy and Refund Policy, are the whole agreement between us about Nyenzo.
